Though I avoid commentary on patent spats at almost all cost (pun intended) the news that Nova and Nanometrics have ended litigation really is a no brainer!

Neither side won, no cash changed hands (as far as the vaguely worded press releases can be trusted) and all for what? One year's agreement not to sue each other!

The no brainer part was in comments by bosses:

"This settlement constitutes an important step toward achieving one of our important goals - moving to profitability," stated Gabi Seligsohn, President and CEO of Nova.

While over at Nanometrics this was the sentiment:

"We are moving on to compete in the marketplace rather than in the court system. The termination of the litigation will result in a substantial reduction in our expenses going forward," stated Bruce Rhine, President and CEO of Nanometrics.

Both companies are not profitable and are small fish in a bigger metrology sea that is dominated by KLA-Tencor.

Though the rationale from both companies is applauded, it's strange that it was absent in the first place!
